1. Agreement and eligibility
These Terms and Conditions are an agreement between you and Five Fifteen Labs, LLC, an Illinois limited liability company, for your use of PacketPacks. By creating an account or using the service, you agree to these terms and acknowledge the Privacy Policy.
You must be at least 18 years old and legally able to enter this agreement. PacketPacks is not offered to anyone under 18. If you do not agree, do not create an account or use the service.
2. Accounts and callsigns
You must provide accurate account information and an active amateur-radio callsign you are authorized to use. You are responsible for safeguarding your password, activity under your account, and promptly notifying us of suspected unauthorized access.
One person may not impersonate another operator, claim another operator’s callsign, evade eligibility limits through multiple accounts, or manipulate account, location, packet, or membership data.
3. Public APRS participation
PacketPacks passively receives public APRS-IS data and may automatically associate qualifying packets transmitted under your registered base callsign and its ordinary SSID variants with your account to determine game eligibility. APRS packets can reveal precise location, time, route, and comments. PacketPacks does not provide an APRS-specific monitoring opt-in or opt-out.
PacketPacks is read-only with respect to amateur-radio systems. It does not transmit to RF, authorize your transmissions, or guarantee that a packet was sent by the account holder. You remain solely responsible for your station and compliance with FCC rules, including 47 CFR § 97.113, and other applicable laws.
Use ordinary, lawful APRS position reports. Do not transmit more frequently for PacketPacks, transmit PacketPacks branding or promotional messages, use hidden meanings or claim codes, cause interference, or send commercial, deceptive, unsafe, or disruptive traffic. PacketPacks does not require a special comment, path, SSID, token, or app-specific transmission.
4. Virtual rewards and free participation
Every eligible user may earn up to seven APRS-awarded packs during any trailing seven-day period, subject to place cooldowns, packet validity, abuse controls, and service availability. Paid membership does not change APRS eligibility, APRS cooldowns, that APRS weekly limit, pack rarity, or randomized pack contents.
PacketPacks may offer optional mini-games or other activities that operate entirely inside the application. Some may require an experience level, achievement, progression milestone, paid membership, or a combination of those requirements. A mini-game may award additional account-bound virtual packs based on completion or performance. Its access requirements, rules, scoring, limits, availability, and possible rewards will be disclosed in the application.
Mini-games do not require or reward additional radio transmissions and do not change APRS earning rules. You may not stake or lose virtual items to enter or play. PacketPacks does not sell packs directly, sell individual attempts or retries, or use packs as credits required to continue a game or extend paid access.
Packs, cards, achievements, experience points, badges, and similar items are limited, revocable, virtual achievements. They have no cash, property, redemption, resale, investment, or transferable value. They may not be sold, traded, auctioned, redeemed, transferred, tokenized, or used for wagering.
5. Paid membership and billing
Paid membership is optional and provides web-app presentation, planning, artwork, statistics, convenience features, and, when offered, access to off-radio mini-games or other digital entertainment. Membership does not purchase APRS eligibility, additional APRS-awarded packs, improved pack odds, or another RF-based advantage. A progression requirement may still apply to a membership feature when disclosed in the application.
The product name, price, currency, and billing interval shown at checkout are supplied from Stripe. Membership automatically renews at the displayed interval until canceled. Access to a mini-game does not guarantee any particular score, outcome, or reward.
Stripe processes payment information. PacketPacks does not store complete card numbers. You can cancel online through the Stripe customer portal. Normal cancellation takes effect at the end of the current paid period, and access continues until then. Fees are nonrefundable and we do not provide prorated refunds or credits except where law requires.
Permanently deleting your PacketPacks account immediately cancels an active membership and ends remaining access. Account deletion does not create a prorated refund except where required by law. Taxes or other charges, when applicable, will be displayed by Stripe before purchase.
6. Safe and lawful use
PacketPacks is a recreational game, not an emergency, dispatch, navigation, tracking, or safety service. Maps, coordinates, radii, availability, packet data, and place information can be delayed, inaccurate, incomplete, or unavailable.
You are responsible for checking current conditions, laws, closures, access rules, property boundaries, weather, and personal safety. Do not trespass, enter restricted or unsafe areas, operate while distracted, or rely on PacketPacks for decisions affecting health, life, property, or emergency response.
7. Acceptable use and intellectual property
We grant you a personal, limited, nonexclusive, nontransferable, revocable license to use PacketPacks for lawful, noncommercial enjoyment. Five Fifteen Labs, LLC and its licensors retain all rights in the service, software, designs, artwork, branding, and content other than information you lawfully provide.
You may not disrupt the service, bypass access or eligibility controls, automate abusive traffic, scrape or republish data, reverse engineer except where law permits, introduce malware, probe for vulnerabilities without written permission, infringe rights, harass others, or use PacketPacks for an unlawful purpose. You grant us the limited rights needed to host, process, and display information you submit to operate the service.
8. Third-party services
PacketPacks depends on services and public data supplied by third parties, including APRS-IS, Callook, Cloudflare, Google Maps, and Stripe. Their own terms and privacy practices apply. Google Maps features are also subject to the Google Maps terms. We are not responsible for third-party availability, accuracy, policies, or independent collection of public APRS data.
PacketPacks is an independent service and is not endorsed by or affiliated with the FCC, APRS-IS, Google, Stripe, or amateur-radio membership organizations merely because their rules, data, or services are referenced.
9. Service changes, suspension, and termination
We may maintain, change, suspend, or discontinue features and may correct, revoke, or remove virtual items affected by error, fraud, abuse, or invalid data. We may limit or terminate access for a material or repeated violation of these terms, legal requirements, security needs, or risk to other users or the service.
You may stop using PacketPacks, cancel paid membership, or permanently delete your account through the controls described in the application. Deleting your account ends future PacketPacks account association for your callsign but cannot prevent APRS-IS or independent recipients from receiving public transmissions.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, PacketPacks is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, availability, or uninterrupted operation.
To the fullest extent permitted by law, Five Fifteen Labs, LLC and its members, personnel, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of use, personal injury arising from unsafe use, or loss of profits. Our aggregate liability for all claims relating to PacketPacks will not exceed the greater of $100 or the amount you paid us during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law does not permit them.
You agree to indemnify Five Fifteen Labs, LLC against third-party claims, damages, and reasonable costs caused by your unlawful conduct, your station operation, content you provide, or your material violation of these terms.
11. Governing law, disputes, and changes
Illinois law governs these terms without regard to conflict-of-law rules. Disputes may be brought in a court of competent jurisdiction in Illinois. These terms do not require arbitration, do not include a class-action waiver, and do not waive rights that cannot lawfully be waived.
If a provision is unenforceable, the remaining provisions remain effective. A delay in enforcement is not a waiver. These terms, together with documents expressly incorporated into them, are the agreement regarding PacketPacks.
We may update these terms. We will post the revised date and provide reasonable notice of material changes through the application or account email. We may require you to accept materially updated terms before continuing to use protected features.
